Case 1

Ladies, and Gentleman, I stand here before you as a representative of the prosecution, which is here, speaking for the state, to prove that this man is sane and should be accountable for his actions.  A person – no, an old, kind, generous, loving man, was killed by this man, this pitiful excuse for man.  These are the things that shouldn’t happen to people as kind as this old man.  The defendant is not insane. Why do I say that? Well, I will tell you why.

The defendant said he was kind to the old man one week before he ruthlessly killed the old man.  This was so the old man was not to expect the defendant was plotting to kill him.  He states that he looked in on the old man every night at midnight, waiting for the right time to kill.  He did this for seven nights.  Now of coarse he had trouble on the eighth night and took the life of the poor and innocent old man.  A madman could not carry out a plan so devious, so careful, and so precise as such.  He hid the body so well the police never saw the body.  It took this man showing them to see it there.  It is just impossible to if he were a madman.

He stated that, AI made up my mind..... to take the life of the old man.@  We all know that he killed the old man but if he were insane could he make up his mine to kill someone?  If I were a madman I wouldn’t think of killing someone and wait for the right time to kill him.  I would just go and kill that person no question asked, no thinking, just killing.  You can=t think if you are a madman, thus my point.

 Now this man said he hated the eye of the old man so he killed him.  Now you might think the eye and the heart beat to be signs of insanity, but it is not.  I know everyone here has something or someone they just can=t stand and will do anything to bet rid of it.  Thus, the old man=s eye was his thing to rid.  Not that he is right he just did what he wanted which here he=s wrong.  Now say you watched a drama or really sad movie and you or the girl you are with is balling out their eyes.  They are letting out their emotions.  This is what this man was trying to do.  The heart beat is a symbol of him trying to let the police now that he killed the old man.  He would not tell the heartbeat was there to drive him to the point of telling.  It was simply hate of himself and the fact he wanted to tell but tried to hold it in.

I have shown the simple fact of he has planed this kill out well. He did not plan on the fact that his inner mind had to let his horrible secret out.  Now I ask that you look at the fact and make the wisest choice.  I thank you all for your time.
